Overview

Welcome to Botversion. These Terms and Conditions ("Terms") govern your access to and use of the Botversion platform, including our web dashboard, SDK, APIs, and all associated services (collectively, the "Service"). By creating an account or using the Service in any way, you agree to be bound by these Terms.

Please read these Terms carefully before using Botversion. If you do not agree with any part of these Terms, you must not use the Service.

Eligibility & Account Registration

To use Botversion, you must meet the following requirements:

• Age You must be at least 18 years old or the legal age of majority in your jurisdiction.
• Authority If registering on behalf of a business or organization, you confirm you have the authority to bind that entity to these Terms.
• Accurate Information You agree to provide accurate, current, and complete information during registration and keep it up to date.
• Account Security You are responsible for maintaining the confidentiality of your account credentials. Any activity under your account is your responsibility. Notify us immediately at support@botversion.com if you suspect unauthorized access.
• One Account Per User Creating multiple accounts to circumvent restrictions or limitations is prohibited.

Acceptable Use

You agree to use Botversion only for lawful purposes and in a manner consistent with these Terms. You must not use the Service to:

• Violate Laws Engage in any activity that violates applicable local, national, or international laws or regulations.
• Mislead Visitors Deploy AI agents that impersonate real people, spread misinformation, or deceive end visitors in a harmful way.
• Reverse Engineer Attempt to decompile, reverse engineer, or extract the source code of the Botversion platform or SDK.
• Overload Systems Deliberately send excessive requests or take any action that unreasonably burdens our infrastructure.
• Resell Without Authorization Resell, sublicense, or redistribute access to the Service without prior written consent from Botversion.
• Unauthorized Data Collection Use the SDK or any Botversion feature to collect visitor data in ways not disclosed to your website visitors or not permitted by applicable law.

Botversion reserves the right to determine, at its sole discretion, what constitutes a violation of acceptable use.

SDK Integration & Website Access

To activate Botversion features on your website, you must integrate our provided SDK code into your website or application. By doing so, you agree to the following:

• Authorized Website You confirm that you own or have the legal right to modify the website where the SDK is installed.
• URL Submission To enable AI-guided assistance features, you must submit your website URL to Botversion for crawling and DOM scanning purposes.
• Visitor Disclosure You are solely responsible for informing your website visitors that AI agents, live chat, and guided automation are active on your site, in accordance with applicable privacy laws.
• SDK Integrity You must not modify, tamper with, or attempt to bypass the SDK code in any way that disrupts the intended functionality of the Service.

DOM Scanning & Crawling

By submitting your website URL and integrating the SDK, you grant Botversion a limited, non-exclusive license to:

• Crawl Your Website Automatically access and index pages on your website to understand its structure and content for AI agent training purposes.
• Perform DOM Scanning Scan and record interactive elements (buttons, links, input fields, and similar components) on your web pages when visited by users, to power guided assistance features.
• Continuous Scanning Re-scan pages when changes are detected or when new pages are visited for the first time, to keep the AI guidance system accurate and up to date.

You represent and warrant that your website does not contain content that violates any third-party intellectual property rights or applicable law, and that granting Botversion this access does not breach any agreement you have with a third party.

Social Media Integration

Botversion allows you to connect your Facebook and Instagram Business accounts to automate responses to incoming messages using AI. By connecting these accounts, you agree that:

• Account Ownership You own or are an authorized administrator of the Facebook or Instagram Business account you connect.
• Meta Platform Policies You will comply with Meta's Platform Terms and Community Standards at all times. Botversion is not responsible for any violations of Meta's policies resulting from your use of the integration.
• AI Responses You acknowledge that AI-generated replies to your social media messages are automated and may not always be perfectly accurate. You remain responsible for the content sent from your business accounts.
• Disconnection You may disconnect your social media accounts at any time. Upon disconnection, Botversion will cease processing messages from those accounts. Previously processed message data may be retained per our Privacy Policy.

AI Disclaimer

Botversion uses artificial intelligence to generate responses, provide guided assistance, and automate interactions. You expressly acknowledge and agree to the following:

• No Accuracy Guarantee AI-generated responses are not guaranteed to be accurate, complete, or error-free. The AI may produce incorrect, outdated, or misleading information. You use AI-generated outputs at your own risk.
• Not Professional Advice Nothing generated by the Botversion AI constitutes legal, medical, financial, or any other form of professional advice.
• No Liability for AI Actions Botversion is not liable for any damages, losses, or consequences arising from actions taken by the AI agent on your website, including but not limited to guided task execution, form interactions, or automated responses sent on your behalf.
• User Review Recommended You are encouraged to regularly review AI responses and agent behavior within your deployment to ensure they meet your standards and comply with your obligations to your users.
• Your Responsibility You are solely responsible for the impact of AI-generated content and actions on your website visitors and business.

Payments, Billing & No Refunds

Access to paid features of Botversion requires a valid subscription. All payments are processed by Paddle, our authorized Merchant of Record, and are denominated in USD.

• Subscription Billing Subscriptions are billed on a recurring basis (monthly or annually, depending on your chosen plan) and will automatically renew unless cancelled before the renewal date.
• Cancellation You may cancel your subscription at any time from your account dashboard. Cancellation takes effect at the end of the current billing period. You will retain access to paid features until that date.
• No Refund Policy All payments made to Botversion are final and non-refundable. We do not offer refunds for any reason, including partial use of a billing period, unused features, or account suspension due to a violation of these Terms.
• Price Changes Botversion reserves the right to change subscription pricing at any time. You will be notified in advance of any price changes affecting your active plan. Continued use after the effective date constitutes acceptance of the new pricing.
• Failed Payments If a payment fails, your account may be downgraded or suspended until the outstanding balance is settled.
• Taxes Prices may be subject to applicable taxes depending on your location. Paddle handles tax collection and remittance as the Merchant of Record.

Intellectual Property

• Botversion IP All rights, title, and interest in the Botversion platform, SDK, dashboard, branding, and underlying technology are owned exclusively by Botversion. These Terms do not grant you any ownership rights in the Service.
• License to Use Subject to these Terms and payment of applicable fees, Botversion grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your internal business purposes.
• Your Content You retain ownership of any content, knowledge base data, or materials you upload to the platform. By uploading content, you grant Botversion a limited license to process and use that content solely to deliver the Service to you.
• Feedback Any feedback, suggestions, or ideas you provide regarding the Service may be used by Botversion without obligation or compensation to you.

Limitation of Liability

To the maximum extent permitted by applicable law, Botversion and its affiliates, officers, employees, and partners shall not be liable for:

• Indirect Damages Any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service.
• AI-Related Damages Any loss or damage caused by AI-generated content, automated actions, guided task execution, or social media responses made by the AI agent on your behalf.
• Data Loss Any loss of data, revenue, or business arising from service interruptions, technical failures, or security incidents beyond our reasonable control.
• Third-Party Actions Any damages resulting from the acts or omissions of third-party services integrated with Botversion, including Meta, Google, or Paddle.

In any case, Botversion's total cumulative liability to you shall not exceed the total amount paid by you to Botversion in the three (3) months immediately preceding the claim.

Suspension & Termination

Botversion reserves the right to suspend or terminate your account immediately and without prior notice if you:

• Violate These Terms Breach any provision of these Terms or our Acceptable Use policy.
• Engage in Illegal Activity Use the Service for any unlawful purpose or in violation of applicable laws.
• Abuse the Platform Misuse the AI agent, SDK, or dashboard in a way that harms visitors, third parties, or Botversion's infrastructure.
• Non-Payment Fail to pay subscription fees when due.
• Provide False Information Submit false, misleading, or fraudulent information during registration or use of the Service.

You may terminate your own account at any time by contacting support@botversion.com. Termination does not relieve you of any obligations incurred prior to termination.

Third-Party Services

Botversion integrates with several third-party platforms to deliver its features. Your use of those integrations is subject to the respective third party's own terms and policies:

• Meta (Facebook & Instagram) Integration subject to Meta's Platform Terms. Botversion is not affiliated with or endorsed by Meta.
• Google (OAuth & Gemini AI) Authentication and AI inference subject to Google's Terms of Service.
• Paddle (Payments) All billing is governed by Paddle's Buyer Terms. Paddle is the Merchant of Record for all transactions.
• Pinecone (Vector Database) Knowledge base storage subject to Pinecone's Terms of Service.

Botversion is not responsible for the availability, accuracy, or conduct of any third-party service. Disruptions to third-party services may affect the functionality of Botversion features without giving rise to any liability on our part.

Changes to These Terms

Botversion may revise these Terms at any time. When we make material changes, we will:

• Update the Date Revise the "Last updated" date at the top of this page.
• Notify Users Send an email notification to registered users for significant changes.
• In-App Notice Display a notice in the platform dashboard when you next log in.

Your continued use of the Service after revised Terms take effect constitutes your acceptance of the changes. If you do not agree to the updated Terms, you must stop using the Service and cancel your subscription.

Governing Law

These Terms shall be governed by and construed in accordance with applicable laws. Any disputes arising out of or in connection with these Terms or the use of the Service shall first be attempted to be resolved through good-faith negotiation between the parties.

If a dispute cannot be resolved through negotiation, it shall be submitted to binding arbitration or the competent courts of the jurisdiction in which Botversion operates, as determined by Botversion at its discretion.
